What land plots are used for the construction of a SPS

There is an opinion that the active development of the RES energy sector, and in particular the construction of the ground-based industrial solar power stations is carried out on lands of agricultural designation, thereby reducing the total state fund of this valuable resource, and also that growing competition increases land rental prices for private farms.

 

Is it true? No.

 

You can't just build a SPS “in the field”.

 

For the construction of industrial solar power stations, only land plots belonging to the category of an industrial energy complex lands are available. Legally, this category most often includes plots with difficult terrain, soils unsuitable for agriculture due to erosion, swampiness, salinization, rockiness and other features of the soil or terrain.

Land plots categories

Depending on the designated purpose, according to the Land Code of Ukraine, plots are divided into the following types:

  • environmental complexes and reserves;
  • agricultural lands;
  • housing and public development plots;
  • recreational areas;
  • plots subject to recreational activities;
  • cultural and historical areas;
  • forestry lands;
  • water fund territories;
  • zones of industrial, military, transport, mining, energy and other industrial complexes of the national economy.

 

Thus, any land plot in Ukraine has its own cadastral number, designated purpose and a number of documents that determine its use. Each type of land resources has its own procedure for changing the designated purpose, a separate regulation for transferring ownership or lease, as well as its own set of restrictions on the designated use of land.

Types of restrictions on the land use

Apart from the designated purpose of a land plot, there are various types of additional restrictions on the use of land, depending on its location relative to neighboring plots, type of surrounding area or other factors.

 

You cannot just build a SPS on a plot if the only thing You know about it is that it relates to the energetic sector lands.

When buying or renting a land plot, be sure to pay attention to the presence or absence of various types of restrictions and encumbrances on its use. There are land plots on which, for various reasons – for example, environmental or urban development – one or another type of economic activity is prohibited.

 

The most common restrictions are applied to:

  • plots in settlements and in high-density development area;
  • plots bordering on objects of historical, archaeological and cultural notability;
  • plots located near protected natural objects and territories;
  • plots near objects of strategic, military and defense importance.

 

In order to acquire a land plot for use, it is necessary to understand not only what type this plot belongs to in terms of its economic designation, but also what types of plots are in the border zone with it.

Restrictions on the use of land plots within boundaries and near settlements

The territories of settlements are mainly intended for housing and utility construction, public facilities, transport infrastructure, municipal buildings, small industries and areas of public recreation and entertainment.

The construction of large industrial plants, except for those that have historically been within the city boundaries, is prohibited. Reconstruction and re-equipment of such facilities requires a special permit, taking into account the observance of sanitary, environmental, acoustic and other technical standards adopted for settlements.

In addition, any settlement and adjacent lands have their own master plan. Land allocation must correspond to the purpose of the production zone. The construction of any facilities that do not comply with the general plan is prohibited. Restrictions are also due to the presence of local or state-level special designation facilities within the limits of settlements - for example, airports, nuclear power stations, large transport hubs, military facilities, etc.

Other types of restrictions on land use

The use of land plots bordering on reserves, national parks, water management and forestry is legally restricted. Similar restrictions are in the vicinity of cultural importance objects – castles, fortresses, ancient settlements and burials. The purpose of such restrictions is to protect these territories from the harmful effects of human economic activity.

Land allotment for the construction of an industrial solar power station is possible in the border territory of the above mentioned zones,

but, the permits will be issued under the strict control of the authorities responsible for the preservation of the cultural and historical heritage of the region and local environmental organizations.

It is virtually impossible to build a SPS on land plots near objects of military and strategic importance – military towns, bases, airfields, training grounds, communication centers and others. The restrictions in this area are very strict.

Conclusions

Land use in Ukraine is strictly controlled. There are many factors that determine the ability to use the land for industrial construction and the constructed facilities most often comply with all the norms of the Law.

Complex of geodetic and geological engineering surveys for the construction of solar power stations

Engineering surveys are an obligatory part of the land plot preparation for the construction of a power station. This is a set of activities for the study of geology and geodesy of an industrial SPS construction area.

It is necessary to take into account natural conditions in the future at each stage of the design works.

Activities are organized as follows:

  • Setting out of the plot boundaries of the power station.
  • Topographic survey for the solar power station design.
  • Engineering geology for the SPS project.

Stage 1

Setting out of the plot boundaries of the power station.

Is performed when a land allotment has already been received, a designated purpose has been legalized (14.01 – for energy facilities) and the Land Use Act has been received.

Setting out is the accurate transfer of the boundaries position points specified in the land survey documents and marking them with special benchmarks – landmarks. The procedure defines the exact boundaries so that you can be sure that all structures related to the power station will not appear to be on someone else's territory.

How the setting out of the plot boundaries is carried out:

  1. The contractor examines the land plot documentation. Determine geodetic control points with known plane coordinates, to which the boundaries landmarks can be anchored.
  2. Natural calculations and on-site measurements are carried out by a team of geodesists. Landmarks are being installed.
  3. An act of boundaries establishment is being drawn up. The owners of neighboring plots agree on it in accordance with a procedure prescribed by law.

Stage 2

Topographic survey for the solar power station design

In order to start developing a power station working design, a topographical plan is required, which will be the basis for the design layouts of facilities.

The contractor conducts a topographic survey of the land plot; the performer must have an appropriate license to execute this type of work.

How the topographic survey is performed:

  1. The survey program is drawn up on the basis of archival topographic maps and plans.
  2. On the land plot territory and next to it, the geodetic control points are established.
  3. A series of planned and altitude measurements is carried out from the points of geodetic survey basis. This is the so-called primary database with the results of geodetic measurements.
  4. A topographic plan is being drawn in a 1: 500 scale. The electronic base of geodetic data on the surveyed plot is being filled in.

Stage 3

Engineering geology for a SPS project

A data on the structure of the earth's crust upper layers are required to design an industrial solar power station. Research is carried out to the depth to which static and dynamic loads, created during construction and installation works and further operation of the facility, are applied.

 

 The choice of foundation for the supporting structures installation on which the power station photovoltaic modules will be installed, depends on the geologic surveys, so that emergencies associated with soil sliding or flooding were eliminated during their operation.

How the geology of the power station plot is being surveyed:

  1. Initial inspection of the territory is carried out to determine its geomorphological structure, geological features.
  2. Wells are being drilled with a list of encountered rocks, soil and groundwater samples are being taken.
  3. Selected samples are examined in the laboratory to calculate the subsoil bearing capacity.
  4. The final technical report on geology contains: physical and mechanical properties of soil, hydrogeological parameters, general and special recommendations for the constructors and designers.
